22 April 2025, A three-member panel of the Classification Review Board has unanimously determined that the publication, Gender Queer by Maia Kobabe, is classified Unrestricted with the consumer advice ‘M – Not recommended for readers under 15 years’. The review of the Classifications Board’s original classification of the publication was remitted to the Review Board following the Federal Court of Australia’s judgment in Gaynor v Minister for Communications & Anor, handed down in October 2024. In reviewing a classification decision, the Review Board applies the Classification (Publications, Films and Computer Games) Act 1995, the National Classification Code and the Guidelines for the Classification of Publications 2005. In the Review Board’s opinion, the Unrestricted classification reflects the publication’s literary, artistic, and educational value, with the consumer advice of ‘M – Not recommended for readers under 15 years’ appropriate to protect younger readers, while ensuring that older teens and adults retain access to diverse and important narratives. The Review Board is an independent merits review body. This Review Board decision takes the place of the original decision made by the Classification Board.
